EPA Issues GHG Endangerment Finding

2009-12-07

Earlier today EPA Administrator Lisa Jackson signed two distinct findings regarding greenhouse gases under section 202(a) of the Clean Air Act:

* Endangerment Finding: The Administrator finds that the current and projected concentrations of the six key well-mixed greenhouse gases--carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), and sulfur hexafluoride (SF6)--in the atmosphere threaten the public health and welfare of current and future generations.

*Cause or Contribute Finding: The Administrator finds that the combined emissions of these well-mixed greenhouse gases from new motor vehicles and new motor vehicle engines contribute to the greenhouse gas pollution which threatens public health and welfare.

ARB's new diesel regs have you confused?

Take advantage of the free on-line interactive webcast training by the Air Resources Board (ARB) on regulations that affect diesel truck, bus, and off-road diesel vehicle owners.

District Proposes Policy for Addressing Greenhouse Gases under CEQA

On November 5, the San Joaquin Valley Air District's Governing Board will consider the first comprehensive regional policy on addressing and mitigating greenhouse gas (GHG) emission impacts caused by industrial, commercial, and residential development in the San Joaquin Valley. This set of guidance documents is designed to assist local permitting agencies and businesses by answering several questions related to the California Environmental Quality Act (CEQA) and how to address GHGs under existing CEQA law. Interested parties are encouraged to provide comments, either now or at the board meeting which will begin at 9 AM on Thursday, Nov. 5. EPA’s Energy Star Label Now Available for Four Types of Glass and Food Processing Plants

  Savings of Nearly $900 Million Possible

 

WASHINGTON - From strawberry jam jars to frozen french fries, the manufacturing plants that make several well-known container and food items in the United States can now earn the U.S. Environmental Protection Agency’s Energy Star for superior energy efficiency. The new Energy Performance Indicators (EPIs) for flat and container glass manufacturing plants and juice and frozen fried potato processing plants are the first of their kind for these industries.

 

The U.S. glass industry spends more than $2 billion annually on energy while the food processing sector spends nearly $7 billion per year. Improving the energy efficiency of these industries by just 10 percent would save nearly $900 million in energy costs and more than 150 trillion btu while reducing greenhouse gas emissions equal to those from the electricity use of more than 1 million homes for a year.

 

The new Energy Star EPIs were developed in partnership with the glass and food industries. The indicators will help companies objectively assess energy performance, set competitive goals for improvement and, over time, shift the energy performance of the entire industry.

Costs of doing business in CA: $134K/yr/small business

Governor Arnold Schwarzenegger released a study recently on the cost of state regulations on California small businesses.  The research, conducted by Sanjay Varshney, concluded that on average, each small business spent $134 thousand on regulations in 2007.  The report also concluded that the total cost of regulation to the state is $493 billion and 3.8 million jobs.

Over the past few years of California's manufacturing and economic decline, the state's regulatory environment has been pinpointed as a primary reason for the high costs and unpredictability that makes the state an uncompetitive place to do business - small or large.  One producer of construction aggregates in the state, Vulcan Materials, testified in an Assembly Jobs Committee hearing in June that it "is not uncommon for the permitting process to involve millions of dollars and in some cases to take as long as 10 years to secure the necessary permits, many of which address duplicative regulatory aspects."

Reminder: Comments due September 30 on Trip Reduction Rule

Comments are due by 5 p.m., Wednesday, Sept. 30 on the San Joaquin Valley Air Pollution Control District's proposed "Employer-Based Trip Reduction Rule." To learn more about this rule, which will impact employers with 100 or more employees who report to work between 6 and 10 a.m., visit:

MCCV urges its member companies to submit comments. The organization will partner with the California League of Food Processors and submit extensive comments.

EPA Finalizes the Nation’s First Greenhouse Gas Reporting System

On January 1, 2010, the U.S. Environmental Protection Agency will, for the first time, require large emitters to begin collecting greenhouse gas (GHG) data under a new reporting system. This new program will cover approximately 85 percent of the nation’s GHG emissions and apply to roughly 10,000 facilities.

EPA’s new reporting system will provide a better understanding of where GHGs are coming from and will guide development of the best possible policies and programs to reduce emissions. The data will also allow businesses to track their own emissions, compare them to similar facilities, and provide assistance in identifying cost effective ways to reduce emissions in the future. This comprehensive, nationwide emissions data will help in the fight against climate change.

The first annual reports for the largest emitting facilities, covering calendar year 2010, will be submitted to EPA in 2011. Vehicle and engine manufacturers outside of the light-duty sector will begin phasing in GHG reporting with model year 2011. Some source categories included in the proposed rule are still under review.

Diesel Regs Too Confusing? Attend ARB Course Tomorrow in Fresno

ARB has developed a new training seminar that provides an overview of several new and existing ARB regulations that apply to diesel vehicle owners. One of the courses is set for 9 a.m. to 3 p.m., Wednesday, Sept. 23 at the San Joaquin Valley Air Pollution Control District, 1990 E Gettysburg, Fresno. You may register on site.

The course will generally provide a 30 minute overview of the
following:

   - Periodic Smoke Inspection/Heavy Duty Vehicle Inspection Program
